Our Report: Google has relaxed its ā€˜Generative AI Prohibited Useā€™ policyā€”which previously banned customers from using its AI tools to make high-risk automated decisionsā€”to clarify that customers can now use its AI tools to make ā€œautomated decisionsā€ in ā€œhigh-riskā€ domains, as long as there is some sort of ā€œhuman interventionā€ during the process.

  • With human supervision, customers can use Googleā€™s AI to make decisions in areas that could impact someone's rights or well-beingā€”such as healthcare or employmentā€”like screening job candidates, for example.

  • Requiring human oversight will help mitigate biasā€”AI is prone to picking up historical biases in dataā€”and give humans accountability, so AI isnā€™t relied upon, as the sole decision-maker.

  • Googleā€™s approach is more flexible than its rivals, OpenAI (which prohibits the use of its AI in all high-risk areas), and Anthropic (which, allows the use of its AI, but it has to be disclosed, and under professional supervision).
